Due Diligence

Due Diligence is a process of verification and, as such, essentially comprises the checking for accuracy and completeness of information already provided to FSS’s Client by third parties, who may, for example, fall into the following categories;

All reports are delivered in writing, supplemented by oral briefings if required.

Litigation Support

Complex international litigation requires accurate and detailed factual presentation.
FSS investigators (many of whom are former law enforcement officers or prosecutors) will work with its Client’s legal advisers particularly to develop background information, locate and obtain documents and to identify, locate and, where necessary, interview potential witnesses.

FSS will also conduct pre-litigation limited Asset Checks in order to identify jurisdictions where potential Defendants’ assets are located and may be potentially blocked in support of intended court proceedings.

Asset Searches

Major defaulting debtors, both individual and corporate, are becoming increasingly sophisticated in their methods of hiding material assets from their creditors, assisted by the increasing volume and complexity of global finance and trade technology, the sophisticated techniques available to Money Launderers and the ability to hide ownership through offshore corporate structures.

As a consequence, in some cases it is not possible to prove absolute beneficial ownership to the satisfaction of a Court. In those circumstances, the objective of an Asset Search is the facilitation of a satisfactory negotiated settlement for the creditor through the provision of accurate and timely information and intelligence to the Client.
